From our BCN Rep and UHNA VP 'Beau' Grant: "Next Big thing.. the BCN seems disposed to work on limiting short term rentals. For reference, several cities have passed ordinances to completely ban short term rentals (shorter than a month) in residential (non-commercial) zoned property in the city limits. For example City of Greenville(SC) banned them a little while back. I understand Greenville County still allows it with some more moderate guidelines, of which I am not familiar. What's not very clear is how an NPU neighborhood such as those which compose the BCN, in absence of a City Ordinance being passed, can do anything at all against nightly rentals other than lobbying for an ordinance change. (I'm for short term rental, but with appropriate taxes, etc. For example, a nightly rental should not enjoy a homestead exemption, hotel taxes should apply to the rental, if police responses occur more than x times a month, the owner is sent a bill (fine) or the police service, offstreet parking requirement, maybe also a minimum rental duration (3-7 days) reducing nightly turnover. not sure what else would be good to reel in some of the excesses created by the industry, but I don't have all day to dig deep into this topic.) If City of Atlanta bans them, we have dozens of other municipal governments nearby that won't ban them, and the business will flow like water to the neighboring cities. In general, short term rentals serve a niche which drives economic activity for the area. How we properly manage it for all of our benefit is another matter. In this way, the nightly rental issue is not unlike the prospective Defoor high density development. Traffic is terrible on our side streets. There's land already zoned to build on within the district that hasn't yet been built. The City has neglected to do anything meaningful with the Howell Mill, Collier, Defoors despite several high profile commercial and residential projects being delivered in just the past 5-7 years. I sketched out solutions 15 yrs ago. Attached, I will roll them out again for the sake of not giving up.. These have been presented numerous times at various planning meetings, etc since them. I think I whipped this up back in 2007. They have been considered quaint, cute.. whatever. I am not a traffic engineer with access to all the diagram software to design roads. Laying out a traffic flow solution could just as well be done with a pencil and price of paper, so long as the idea is clearly presented. Anyhow, it's attached for your perusal. Thank you for all your research and work that has gone into this. This is not just for neighborhoods with declarations, it is for any neighborhood association and is based on the Georgia HOA laws. I have heard from several neighborhoods that are going to pursue this restriction. Please let me know if you are interested. We want as many neighborhoods as possible to join in this effort.
