from Eva Nason, UHNA Rep to NPU-D-

All those who can attend the ZRB meeting on September 7 beginning 6:00 p.m. in City Council chambers on the second floor of City Hall at 55 Trinity Ave are encouraged to do so.
Rezoning case Z-23-17 for 1692 Springer St. was deferred from July 13 until Thursday, September 7.
Below is information again regarding how this rezoning case can be opposed.

Regarding attendance at the Zoning Review Board meeting:
All those who can attend the ZRB meeting beginning 6:00 p.m in City Council chambers on the second floor of City Hall at 55 Trinity Ave are encouraged to do so.  All those people who come to support opposition to this rezoning will be able to show their opposition by raising their hand or standing when they are asked to do so. Their presence is important! There will be a speaker plan in place for speakers to make the case for opposition to Z-23-17, but if time remains of the allotted 10 minutes, then anyone can fill the time.

Z-23-17 is the fifth rezoning case listed on the agenda to be heard.  Parking is available at the Government Center Parking Deck across Trinity Ave from the entrance to City Hall, and this garage can be accessed from Washington St. from the north or Central Ave. from the south.

Regarding written communication to the Zoning Review Board:
If anyone wishes to communicate in writing to the ZRB regarding Z-23-17, he or she can do so by sending an email to the following:
                             [email protected]

Following is a list of some items that might be mentioned if one wishes to suggest reasons why this rezoning should not be approved.
1. The rezoning would not be consistent with the Comprehensive Development Plan.
2.  No rationale has been given for public support of this rezoning.
3.  The rezoning would be purely for the convenience and/or speculation of the property owner to the detriment of a purely residential street.
4.  The building on the property is consistent with the current zoning since it is similar to the adjacent single-family residences.
5.  The commercial rezoning of the property would permit the type of non-residential building not at all consistent with the adjacent single-family residences.
6.  A precedent would be set for the intrusion of non-residential development on the first property of an otherwise purely residential street at the core of a neighborhood.
7.  At the April 25 NPU-D meeting, the vote taken on Z-23-17 was 98 members in opposition to 6 in support!  At the preceding Underwood Hills Neighborhood Association meeting on April 17, the vote was 60-2 in opposition.

8/28/2023

Picture
Councilmember Marci Collier Overstreet, recently sent out  information regarding Invest Atlanta's Owner Occupied Rehab Program. I wanted to share that information with Buckhead residents as well.
Invest Atlanta and the City of Atlanta will offer a deferred forgivable loan program that provides up to $30,000 to eligible City of Atlanta homeowners for specific health and safety repairs of major systems on their home. The loan will be either 5 or 10 years at a 0% interest rate with payments deferred and forgiven until the earlier of loan maturity, sale, transfer of ownership, or failure to maintain the property as the primary residence during the term of the loan.

Direct construction amounts of $15,000 or less have a 5-year term, and direct construction amounts over $15,000 will have a 10-year term. The principal balance is reduced by 10% or 20% annually provided the eligible homeowner maintains primary residency. The prorated remaining balance is due and payable immediately if the home is sold, transferred, or no longer the primary residence during the term of the loan. A lien will be placed on the home.

Squatters and Tresspassers- BCN

8/28/2023

Picture
from Debra Wathen
Chairman, Buckhead Council of Neighborhoods
"
Dear Neighborhood Presidents and BCN Representatives,
I am passing along an important caution from our Zone 2’s Major Mitchell related to unoccupied houses including those for rent and for sale.  He is seeing an increase in the number of squatters in these houses.  They move in, change the locks, provide fake leases and then the process gets complicated.   In some cases  you must go through the long eviction process to get them out of the property.
Please let your neighbors know to put NO TRESPASSING signs in the yard.   By doing this, you are giving them notice that they are not welcome.  It is easier to evict a trespasser than it is a squatter. Police can only remove a trespasser and cannot remove a squatter unless the proper civil court proceedings have taken place.
If you have a squatter or trespasser on your property, notify the Atlanta Police Department right away and you should immediately serve squatters with an eviction notice.  Squatters, although on your property illegally, do have some rights like a tenant that pays rent.

Here is a link to an article that talks about the eviction process of a squatter in Georgia.  "

Subject: Re: Safety Issues: Bus Route 1012: URGENT
On Aug 23, 2023
"Good morning: This is regarding bus 21-019.
[student name, ID]
School Bus route 1012 stops at [ie Defoor Ave NW & Davis Circle] and is full of children standing up all the way to NORTH ATLANTA HIGH SCHOOL.

My child is currently standing up while the bus drives up the interstate. This is unacceptable and unsafe. If that bus needs to break on the interstate, children would fly through the windshield.

Please respond outlining the steps being taken to address this.
